Kyle has always viewed litigation as being about people and personalities as much as it is about the law.
As such, Kyle has developed extensive expertise in negotiation theory, including numerous published papers and speaking engagements on topics such as behavioral decision-making, cognitive biases, heuristics and non-verbal communication.
In his litigation practice, Kyle was known as a “fixer” for litigation files that had gone off the rails. This reputation has come both from an ability to deal with complicated litigation issues, as well as his ability to deal with difficult personalities. Kyle litigated lengthy and complex trials, including one of the longest civil trials in Canadian history (106 trial days over 2.5 years), while also utilizing his experience in negotiation theory to resolve many other large and complex actions.
As a mediator and arbitrator, Kyle leverages this expertise to help facilitate resolutions between parties who have become entrenched in the litigation process, helping parties to find timely and creative solutions outside of the courtroom.
